Release and Waiver of Legal Liability

PLEASE READ CAREFULLY! THIS LEGAL DOCUMENT AFFECTS YOUR LEGAL RIGHTS!

Volunteer. I desire to work as a volunteer for TSF and engage in the activities related to being a volunteer. TSF provides long-term care for underprivileged children afflicted with cranio-maxillo-facial and dental deformities. Including, but not limited to; craniofacial, cleft lip and palate surgery, orthodontic and dental services, dental hygiene and nutrition education, audio, speech and ear, nose and throat screenings. The work takes place in Mexico at the clinic in Ensenada and local hospitals in Mexico. I understand that the Activities include traveling to Mexico and may also include working with patients and their families, working with and moving equipment and supplies, transportation to and from project locations and consuming food, or working in the TSF project worksites. I understand I will receive no compensation or remuneration for my services or material furnished. I hereby freely, voluntarily, and without duress executes this Release under the following terms:

  • Release and Waiver. I, the volunteer, hereby release and forever discharge and hold harmless TSF and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Volunteer's Activities with TSF. I understand that this Release discharges TSF from any liability or claim that the I may have against TSF with respect to any bodily injury, kidnapping, personal injury, illness, death, or property damage that may result from Volunteer's Activities with TSF, whether caused by the negligence of TSF or its officers, directors, employees, or agents and/or others acting on its behalf as set out in this writing. I also understand that TSF does not assume any responsibility for, or obligation to provide financial assistance or other assistance, including but not limited to medical, health, liability or disability insurance in the event of kidnapping, injury or illness. I agree that this Release is effective immediately and that this release is complete and forever.
    • Assumption of the Risk. I hereby expressly and specifically assume any and all risk of injury, kidnapping, illness, death, or property damage resulting from my travel and activities as a volunteer while working for TSF. I understand that the Activities may include work that may be hazardous to the Volunteer, including, but not limited to, travel, working with patients, handling supplies and equipment, loading and unloading, and transportation to and from the project and project worksites. I understand the risks involved and accept all of the risks.
    • Medical Release. I hereby release and forever discharge TSF from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Volunteers Activities with TSF.
    • I take full responsibility for my welfare and safety during my travel and on the project worksites.
    • I hereby give permission for emergency medical treatment to be administered as deemed appropriate.
  • Insurance. I AM EXPECTED TO HAVE MY OWN HEALTH INSURANCE. I understand that TSF does not carry insurance to cover injuries, illness, and losses of Volunteers. I am not relying upon TSF to maintain insurance coverage if I am kidnapped, injured or killed.
  • Photographic Release. I hereby grant and convey unto TSF all right, title, and interest in any and all photographic images and video or audio recordings made by TSF during the Volunteer's Activities with TSF, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
  • Other. I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of California and that this Release shall be governed by and interpreted in accordance with the laws of the State of California. I agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release, which shall continue to be enforceable.
  • Minors. It is the policy of TSF that children volunteers under the age of 18 not be allowed on a TSF project or project worksite. It is further the policy of TSF that, children between the ages of 14 and 18 may be allowed to participate in volunteer work under direct adult supervision approved in advance by TSF.
